Nissin Japan Ltd. Repair Service Terms and Conditions
Article 1: Application of Terms
These terms and conditions set forth the basic conditions applicable to various repair services (including firmware updates) (hereinafter referred to as "the Service") provided by Nissin Japan Ltd. (hereinafter referred to as "the Company").
As the Company provides the Service to customers in accordance with these terms and conditions, please ensure you agree to these terms prior to using the Service.
Article 2: Scope of Service
The Company provides this Service for products sold within Japan that are designated as eligible for the Service on the Company's website, as well as the accompanying accessories (excluding consumables), provided that the Company determines it is capable of performing the repair. Please note that some products and accessories may be ineligible; for details, please contact us via the inquiry form.
The Company provides this Service exclusively to customers residing or currently staying in Japan, and only within the territory of Japan.
If a customer is enrolled in independent warranties, insurance, or other services provided by retailers or other third parties (hereinafter referred to as "Third-Party Services"), the customer must confirm with the retailer whether those services apply to the Company's products before requesting this Service. The terms, conditions, and scope of such Third-Party Services are determined by the agreement between the customer and the retailer, and the Company assumes no responsibility for them.
Article 3: Formation of Contract
A contract for this Service based on these terms is formed when the customer requests the service for a Nissin product (hereinafter "the Product for Repair") using the Company's specified method as described on our website, and the Company accepts the request after verifying the necessary information and confirming the eligibility for the Service.
Please note that, in addition to the cases specified in these terms, the Company may be unable to provide the Service depending on the details, timing, method, provided information, or other circumstances of the request, and may refuse a request at our discretion.
Article 4: Purpose of Repair
The Company provides the Service for the purpose of restoring and maintaining the functions and performance of the Company's product owned by the customer in the event of a failure.
Depending on the condition and circumstances discovered during inspection, it may not be possible to repair the Product for Repair.
If the Company determines that repair is impossible, difficult, or unreasonable due to the state of the product, the location of the fault, or other company-related circumstances, the Company may, at its discretion, provide an equivalent replacement product (including similar products or different models) (hereinafter "Refurbished Product"). This exchange shall be deemed as completion of the Service. If the customer does not agree to the exchange, the request for the Service will be treated as canceled.
Article 5: Requesting a Repair
To request a repair, please apply for the Service via our website and send the product to us, or consult with an authorized dealer. If requesting a repair within three months of purchase, please contact us via the inquiry form.
When sending the Product for Repair, unless instructed otherwise by the Company, please remove any batteries, stickers, flash accessories, diffusers, etc. (hereinafter "Add-ons") that were attached by the customer. Please be aware that if it is necessary to remove Add-ons for repair, we may do so without prior notice. The Company assumes no responsibility for any contamination, damage, loss, or other damages related to Add-ons if they are left attached to or included with the Product for Repair when submitted.
The Company assumes no responsibility for any damages incurred by the customer due to incorrect information (such as address or product name) entered when applying via the Company website. Please verify that all input information is correct.
Article 6: Warranty Repair
If the request is covered by the Company's warranty repair/replacement policy, the specific warranty provisions stated on the Company's website shall take precedence, and the Company will repair or replace the product free of charge in accordance with those provisions. Please note that even within the warranty period, malfunctions caused by the deterioration of consumables (*1), improper use or environments, or damage due to customer negligence may not be covered by free repair. If not covered by the warranty, the Company will perform the repair as a paid service under these terms.
*1 Refers to items such as Fresnel lenses, flash tubes (discharge tubes), power cords, locking pins for mounting feet, click pins, click springs, and various screws.
Article 7: Outsourcing of Repair Operations
The Company may, at its own discretion and responsibility, outsource part of the Service (including related incidental tasks) to partner companies.
Article 8: Charges and Estimates
The Service fees (including repair charges and other costs; hereinafter "Service Fees") shall be determined according to the Company's specified rates.
If a customer specifies a maximum budget in advance and the Company's estimate confirms the cost is within this amount, we will proceed with the repair without further notice. If the estimate exceeds the specified amount, we will notify the customer of the estimated cost and request confirmation of whether to proceed. Estimates are valid for one month. If no response is received within one month, the request for the Service will be deemed canceled, and the Product for Repair will be returned.
Article 9: Canceling a Repair
If a repair is canceled after an estimate is provided, or if the product is returned after inspection reveals no defects, the Company will charge the customer for the operational inspection fee.
Article 10: Provision of Loaner Equipment
The provision of loaner equipment while a product is being repaired is not included in this Service, and the Company has no obligation to provide such equipment. However, for certain models designated by the Company, a paid loaner service is available for the same model. Please specify your request for a loaner on the repair request form. The Company assumes no responsibility for any loss of shooting opportunities or other damages arising from defects in the loaner equipment.
The separate "Terms of Use for Rental Loaner Equipment" shall take precedence regarding the rental of loaner equipment.
Article 11: Handling of Repair Parts
To ensure long-term and stable provision of the Service, the Company may use refurbished or substitute parts at its discretion.
Parts removed during the Service will be collected for recycling or analysis. These collected parts become the property of the Company and may be reused, recycled, or disposed of at our discretion.
Article 12: Parts Retention Period
The Company maintains a retention period of 5 years after the end of production for performance parts necessary for maintaining product functionality. The period during which the Service can be provided is limited to this parts retention period (excluding accessories such as cases and diffuser caps). However, if parts are out of stock, the Service may be terminated prior to the end of this period.
Article 13: Repair Warranty
If a defect is not resolved after repair, the repair warranty provisions stated on the Company's website shall take precedence, and the Company will re-repair the product free of charge in accordance with those provisions.
Article 14: Storage of Repaired Items
The Company will store the repaired product for 6 months from the date of repair completion (hereinafter "Storage Period"). If the customer does not claim the repaired or exchanged product (hereinafter "Returned Item") within these 6 months, the Company may charge the customer for storage costs and disposal expenses. Furthermore, if the Returned Item remains unclaimed after 6 months, the Company may dispose of, recycle, or utilize the item at its discretion.
If the Service is provided via the exchange of the Product for Repair for an exchange product, the exchange is deemed completed once the Company's processing is finished and the exchange product is ready for delivery. Ownership of the Product for Repair will then transfer from the customer to the Company, and ownership of the exchange product will transfer from the Company to the customer.
Article 15: Change of Contact Information
Please notify the Company promptly if your address, phone number, or email address changes before the Service is completed.
Even if items sent by mail or other delivery methods are not received due to an unknown address, the Company will consider them delivered if they were sent to the address provided by the customer.
Even if emails sent by the Company are not received due to incorrect addresses or internet issues, the Company will consider them delivered if they were sent to the email address provided by the customer.
Article 16: Limitation of Liability
The liability of the Company regarding the provision of the Service is limited to the items specified in these terms, except in cases of intent or gross negligence by the Company. The Company assumes no responsibility for any special damages, lost profits, claims from third parties, or other damages resulting from the inability to use the product due to failure or defects. Even if damage or contamination occurs while the Returned Item is in the Company's possession, the Company will, in principle, only respond by performing a repair.
Even if the Company is held liable for damages, the total liability shall not exceed the value of the Product for Repair. The value shall be calculated based on the residual value after depreciation or the market price of an equivalent product at the time the damage occurred.
Article 17: Exclusion of Antisocial Forces
If it is discovered that the customer is an antisocial force (as defined under Japanese law, including organized crime groups, their members, or related parties), the Company may terminate all or part of the service contract at any time, without prior notice, upon such discovery.
Article 18: Miscellaneous
These terms are valid only within Japan. These terms do not limit the customer's legal rights. Matters not covered herein shall be determined through mutual consultation.
If any provision of these terms is deemed invalid by law, the remaining provisions shall remain in full force and effect to the extent permitted by law.
Failure by the Company to exercise any right under these terms at any given time or for any specific event shall not be considered a waiver of those rights, nor shall it be interpreted as a failure to exercise such rights in the future or for similar events.
These terms shall be governed by and interpreted in accordance with the laws of Japan.
For the handling of personal information provided when using this service, please see the Privacy Policy page on the Company's website.
Article 19: Changes to Terms
The Company may change these terms at its discretion without prior notice. The terms in effect at the time of the request will apply; therefore, please ensure you check the applicable terms at the time of your request.
For services requested before a change in these terms, the terms in effect prior to the change will continue to apply.
